This “terms & conditions” is an agreement between “You” and “ECR TRAVEL -Our Company

Personal Information of your clients

Please submit to us with correct information of your guests as below, we will keep them confidential;
– Full names (as stated in the passport), age, sex, contact details, flight details, accommodation preferences,
– Requirements for their special needs, for example: person with difficulties in walking, vegetarian, etc…

Prices & Inclusion

Our price is NET and you add your own margin to sell to your clients, we will not give the price directly to the clients unless you wish to. Please check the services included. We are not responsible for any services not mentioned in there.

Price validity is written on the quote, please refer to the final confirmation of the program.

Contract & Financial Bonding
The contract agreement will consist of the agreed itinerary with your approval on case by case basis on: tour program, timing, service type and services included, value and others mentioned in the itinerary. And, your acceptance of these terms and conditions.

Services Availability & Our Changes
As soon as we have received your booking request, reservation of the services will be made as per agreed. The service in your client’s confirmed travel itinerary are sometimes not available so please expect an alternative of the similar value.

Payment:

For the bookings which are booked 30 days before departure date:
An advanced deposit from 50% of the total cost is required to guarantee your booking. And the balance will be settled 2 weeks before the departure date.

For the bookings which are booked less than 30 days before departure date:

If your booking is too close to the departure date (normally less 30 days), the full payment will be paid in advance.

Amendment & Cancellation:

Amendment:

If you wish to amend the services, we will try to change it at the same value if this/these service(s) are still open for amendment. Extra charges will be made if your amendment or upgrade is higher than our agreement (for example: , some airlines will charge for changing names and departure date).

Cancellation:

The date of cancellation is the date we receive your notification by email/phone. The cancellation fees are as followed:

– It’s free of charge if you cancel the booking up to 30 days before arrival of the clients. However, you will have to pay the cancellation fee of the services that were booked with cancellation fee or fee of the non-refundable services (such as airlines bookings…)

– If you cancel the booking 29 days prior to your departure: You will have to pay 10% of total tour cost plus any bank fees.

– If you cancel the booking 28 to 16 days prior to the guest’s departure: You will have to pay 40% of total tour cost plus any bank fees that result from here

– If you cancel 15 days to 8 days before the guest’s departure: 65% of total tour cost plus any bank fees.

– If you cancel 7 to 4 days before your guest’s departure: 85% of total tour cost plus any bank fees.

– If you cancel 3 to 1 day(s) before your guest’s departure or on the arrival date: Full charge of the tours – there is no refund on this.

Should we experience severe weather conditions we will contact you immediately and offer you/your clients the choice of an alternative of equivalent quality or a partial refund. No additional compensation will be paid over.

There is no refund or exchange that can be made for unused services not utilized by the tour member

Visa to enter Vietnam:
Please note that visa is not normally included in our tourprogram, if you request a visa on arrival for your guests, please contact our travel consultants at least 7 days before their arrival.

Complaints & Refund:
Please notice your clients before their trip that during the tour, should any problems arise, please inform our tour guide or tour operator as soon as possible so that we can solve the problem for them.
If the problem could not be resolved on the tour, please email usand give us some time to rectify the situation.
If again we cannot resolve the problem, we will make you an offer of refund or compensation. This amount of refund can be transferred to you via bank wire or we use this amount for the next booking’s reduction.

Insurance & Medical Precautions:

All of tours and services do not include any type of insurance. Please suggest your clients to do this in their country before traveling to Vietnam. They should also ensure that you are fully up to date with vaccinations required.
If they are involved in adventurous activities, such as cycling, trekking, etc., they should check with your medical practitioner if they are in any doubt about your fitness to do so.
In case of illness or injury, we help to arrange necessary treatment. Travelers have to cover the cost of treatment.

Responsibility & Disclaimers

We are responsible for making sure that each part of the holiday you book with us is provided to a standard and as was advertised by us (or as changed and accepted by you). If any part of your client’s holiday is not provided as described and this spoils their holiday, we will pay you appropriate compensation unless this is due to reasons beyond our control, see below.

Our final & correct confirmation for tour itinerary, services type, etc. will be done in written form via email communication and effective on the booking confirmation email by us.

We will not be responsible for any injury, illness or death was caused by an event or circumstances which the person who caused it could not have predicted or avoided even if they had taken all necessary and due care,

We will not take any responsibility for any injury, damage, death, loss, accident or delay caused by threat of wars, civil strife, industrial disputes, natural disasters or terrorism.
ECR Travel will take no responsibility for any omission, delay, re-touring, additional expenses, or other resulting from improper health, necessary documents to enter or depart a country, or acts by any government authority.

If your client is injured, falls ill or dies, they need to incur unpredictable extra expenses for which we are not liable because the event is beyond our control (stated above) we will, where appropriate and subject to our discretion, try to help if we can. For example, we can help by providing translation services, communicating with authorities, recommending foreign lawyers (if necessary), explaining the procedures they should follow…

We reserve the right to decline the booking if we have caused to believe that your clients might pose a threat to public safety and/or security in Vietnam.

Governing Law

These Terms & Conditions are governed by Vietnam laws. You herby submit to the exclusive jurisdiction of Vietnam’s courts in all disputes or any other action arising out of or in relation to these Terms & Conditions
